User Agreement

All direct Customers of LunarVPS's basic services are subject to the terms and conditions contained in the User Agreement. The User Agreement is a legal contract between LunarVPS and the User that contains the rights, duties and obligations of LunarVPS and the User.

Failure to Pay

Accounts that reach 7 days past due will be suspended and will be added a late fee of $2 to recover your service online. LunarVPS will terminate your service after the 7th day of suspension. We could deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees. .

Refund Policy

Our Virtual Server series carry a 7-day money back guarantee with a valid reason requirement for cancellation. Valid reasons include issues which are caused due to fault of lunarvps. You may be charged for the resources you have used which can include but are not limited to bandwidth, ram and hard disk space. The upgrades, one time fees, setup fees, software package fees, whatsoever are non-refundable.

Prohibited Usage

A list of prohibited content can be found below, which includes but not limited to the following:

• Scam Sites (ex: Ebay/Paypal,CC/Password Scam sites)
• Child pornography
• Virtual currency mining (such as bitcoin, primecoin etc)
• Malware/virus/security exploit activities
• Terrorist activities
• Email spam
• Phishing
• Port scanning, brute forcing or any other hacking attempts
• DDoS/DoS/booters/network floods or similar network attacks activities
• Anything than can result in Spamhaus listing

If any of the above are detected, your service(s) will be terminated or suspended without notice and no refund shall be granted. lunarvps reserves the right to provide no refund if any of the above activity is detected. Any threats made towards lunarvps or it’s staff will be forwarded to authorities.

Port Speed and Bandwidth

Over our website, port speed means the speed of the network interface that has been given to your server. This usually is 100Mbps, 1Gbps or 10Gbps. Bandwidth means the amount of data transfer you are allowed to transfer on the network, both going out of your server, or coming in to your server. This means both incoming and outgoing traffic is counted. Unmetered means that we will not monitor your bandwidth usage and you can use your port fully, all the time, without any limitations. If there is a bandwidth limit, it means that you are not allowed to use more bandwidth than the limit in one month. If you go over your bandwidth limit, overage will be charged as $5/1TB.

Backup and Data Loss

Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. LunarVPS is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on LunarVPS's servers.

Termination Due to Breach

In the event that Customer commits a material breach of any of its obligations hereunder, lunarvps may terminate this Agreement or (at lunarvps sole option) suspend, interrupt or terminate one or more Service(s) to which such breach pertains by sending written notice of termination to Customer with termination effective as stated on the electronic mail notice.

Conclusion

If you are terminated due to a violation of our terms of service you agree that you will not receive any partial refunds and that this shall be considered a reasonable estimate of the liquidated damage and not a penalty.
